On 12/03/2020, it was directed that the applicant shall not be arrested and the said order is in force till date. After 18/03/2020, the application was never listed. 3.
Learned A.P.P., on instructions from the Investigating Officer, who is present in the Court, states that the investigation is complete and the charge-sheet has been filed against the arrested accused. She makes a specific statement M.M.Salgaonkar
2/2 7 ABA-608-20.doc that the custodial interrogation of the applicant is not warranted.
In the wake of the above statement, the order directing that the applicant shall not be arrested deserve to be confirmed. Hence, the following order.
: ORDER :
(a) Application is allowed.
(b) In the event of arrest in connection with C.R.No.423 of 2019 registered with Vashi Police Station, applicant-Jaya Rahul Avhad shall be released on bail on furnishing P.R. Bond to the extent of Rs.25,000/- with one or two sureties in the like amount.
(c) The applicant shall attend the trial on regular basis.
(d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer and shall not tamper with evidence.
