Leave to amend so as to delete the respondent no. 2 as learned counsel for the applicant wants to delete respondent no.2. Amendment to be carried out within a week.

This is an application for pre-arrest bail. The applicant is apprehending arrest in connection with C.R. No.43 of 2023 dated 23/01/2023 registered with Achole Police 1/3

Station for offence punishable under sections 376, 377, 498-A, 354-A, 354-D, 406, 504 of the Indian Penal Code, 1860.

The applicant is the sister-in-law of the complainant. The marriage between the complainant and the applicant's brother was solemnized on 12/05/2022. it is alleged by the complainant that the in-laws were harassing her on trifle issues. The complainant hardly stayed in the matrimonial home for two months. It is alleged that the applicant along with in-laws committed offence under the aforesaid sections. The applicant is the sister-in-law of the complainant. The accusations made against the applicant are general in nature. The custodial interrogation of the applicant is not necessary. The accusations are mainly against the husband and father in law. Hence, the following order.

O R D E R

(a) The application is allowed.

(b) In the event of arrest of the applicant in connection with C.R.No.43/2023 dated 23/01/2023 2/3

registered with Achole Police Station, the applicantMrs. Babita Adarsh Dubey be released on bail on her furnishing P.R. Bond in the sum of Rs.15,000/- with one or more sureties in the like amount;

(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and should not tamper with evidence;

(d) The applicant shall report to investigating officer on 2nd March 2023 between 11.00 a.m. and 1.00 p.m.
