(1) This is an Application for condonation of delay of 249 days in preferring present Appeal.

(2) Mr. Gharat, learned Special Public Prosecutor has vehemently opposed Application and submitted that, no proper explanation has been offered by Applicant for condonation of such huge delay and therefore delay may not be condoned.

(3) Learned Advocate for Applicant submitted that, Applicant has offered necessary explanation for the said delay, however, taking into consideration opposition by learned Special Public Prosecutor, Applicant is ready and willing to pay cost of Rs.10,000/- to the Advocates' Association of Western India Generation Next Fund, Mumbai for condonation of the same. 1/2

Ia-701-2024.doc (4) In view thereof and on the basis of submission made by learned Advocate for Applicant, Applicant shall pay cost of Rs.10,000/- to the Advocates' Association of Western India Generation Next Fund, Mumbai, within a period of one week from the date of uploading of present Order. The said statement is accepted as an undertaking given to this Court. (4.1) Details of the bank account for payment of cost are as under :- Account Name :- Advocates Association of Western India Generation Next.

(6) It is made clear that, if the cost is not paid within stipulated period as mentioned above, the Application shall stand revived automatically. (7) List the Application on board on 3rd May 2024, under caption 'for reporting compliance' of present Order.
