Heard Mr. Kapadia, learned Counsel for petitioners, Mr. Pawar, learned Counsel for respondents No.1 and 3 and Mr. Rayrikar, learned AGP for respondents No.2 and 4 in all the Petitions at length. 2.

These Petitions take exception to the orders dated 30.01.2017 passed by the respondent No.2, Deputy Registrar, Co-operative Societies. By that order, respondent No.2 issued recovery certificates under Section 101 of the Maharashtra Co-operative Societies Act, 1960. 3.

After arguing the Petitions for quite some, Mr. Kapadia, upon taking instructions from Pradipta Bijay Shankar Datta, proprietor of petitioner No.1, who is present in the Court, seeks permission to withdraw these Petitions. He states that within two weeks from today, petitioners will submit proposals to the first respondent for availing benefit of One Time Settlement (O.T.S.) scheme. 1/2

Mr. Pawar, upon taking instructions from Ms Shraddha Amaldar, Manager (Legal) of the respondent No.1, states that within four weeks from the receipt of the proposals of the petitioner in all these Petitions, respondent No.1 will take appropriate decision in accordance with law. 5.

On the motion made by Mr. Kapadia, Petitions are allowed to be withdrawn with liberty as prayed for and are disposed of as such. Petitioners shall submit proposals for availing benefit of O.T.S. within two weeks from today to the first respondent. Respondent No.1 will take appropriate decision on the said proposals within four weeks from the date of receipt of the proposals in accordance with law. It is made clear that if the petitioners do not submit the proposals within two weeks from today, respondent No.1 will be at liberty to proceed in accordance with law. In case, the O.T.S. proposals are rejected by the respondent No.1, petitioners are at liberty to adopt appropriate remedy in accordance with law. Order accordingly.
