Mr. Kadam, learned counsel for the petitioners, at the outset, makes a statement that he restricts this petition to the relief claimed in prayer clause (D). Prayer clause (D) reads as under :- "(D) By way of writ of mandamus, or any other appropriate writ, order or directions in the like nature, the Respondent No.1 may kindly be directed to decide the Representation dated 10/08/2017 submitted by the petitioners within stipulated period."

In light of above, we deem it convenient to dispose of this

Mhi WP-3316-18.doc petition by directing the Secretary, Higher & Technical Education Department, Mantralaya, Mumbai, to decide the petitioners' representation dated 10.8.2017, Exhibit "J", as expeditiously as possible, and preferably within four months from the date of receipt of this order. Ordered accordingly.

It is expressly made clear that we have not gone into merits of the petitioners' claim. All points and contentions of the respective parties are kept open.

Respondent No.1 shall decide the said proposal/representation independently, on its own merits and in accordance with law.

In order to enable Respondent No.1 to comply with this order, the petitioners shall remain present before the Secretary, Higher & Technical Education Department, Mantralaya, Mumbai on 9.4.2018 along with a copy of this order as also a copy of the said representation.
