Heard. The transfer is sought on the ground of ill health of brother and mother of applicant.

Applicant is already denied permission to appear in person. Still this Court thought it ft to hear the applicant in the interest of justice.

2 12.90.19 appln.doc In the scheme of Section 407 of Code of Criminal Procedure, 1973, ill health of blood relation cannot be considered to be a ground to be basis for ordering transfer.

In the aforesaid background, there is no substance in the application. Application is rejected.

However, since it is brought to the notice of this Court that applicant is not paid maintenance amount, inspite of order to that effect passed by the Magistrate, it will be appropriate to direct expeditious disposal of proceedings. Accordingly, proceedings are expedited.
