This matter was called out in the morning session and kept back as none appeared for the Applicant. In the afternoon session again when the matter is called out, none appears for the Applicant. 2.

On the earlier occasion, i.e. on 29th September, 2023, the following order was passed:- "1. In the morning session when this matter was called out, none appeared for the Applicant and therefore, this matter was kept back. In the afternoon session, again none appears for the Applicant.

2. A perusal of the order dated 14th September, 2023 indicates that none was present for the Applicant on that date also.

3. The remarks column in the cause-list indicates that the Respondent has been duly served.

4. List this matter on 20th October, 2023.

5. It is made clear that if none appears for the Applicant on the next date, this Court will consider dismissing the application."

3. It can be seen from the paragraph- 5 of the afore-quoted order that it was made clear that if none appears for the Applicant on the next date, this Court will consider dismissing the application. 4.

None has appeared for the Applicant today. Accordingly, application stands dismissed.
