1] Heard learned counsel for the parties.

2] Sufficient cause has been shown for the delay in institution of this appeal. The circumstances set out in paragraphs 9 and 10 make out a sufficient cause. Accordingly, the delay in institution of this appeal is condoned. The Appellant shall pay costs of Rs.10,000/- (Rupees Ten Thousand). Mr. Bhanage, learned counsel for the respondent states that such costs may be paid to the Tata Memorial Hospital. The gesture is appreciated. Costs to be paid accordingly to the Tata Memorial Hospital within a period of four weeks from today.
