This is an application for recalling the order dated 12th February, 2018 passed in the instant appeal so far as it relates to directing the Trial Court to take necessary steps by issuing warrant of commitment for directing applicants/appellant/accused nos.4 and 5 to undergo the jail sentence imposed on them.

The warrant of commitment was directed to be issued as against appellant/accused nos.4 and 5 as the learned Judge of City Civil & Sessions Court vide report dated 15th November, 2017 had reported this Court that these two appellants have not furnished surety till date. Vina k 1/2

The applicants/appellant nos.4 and 5, to this application have annexed the document to show that they have furnished solvent sureties and the Court below is taking necessary steps for verification of sureties.

As the applicants/appellant/accused nos.4 and 5 stated to have furnished sureties before the Trial Court, the order dated 12th February, 2018 passed in this appeal so far as it directs the Trial Court to issue warrant of commitment thereby compelling the applicants/appellant/accused nos.4 and 5 to undergo jail sentence is recalled.
