This Petition is filed for directions to the Trial Court to frame the issues and decide the trial within a period of one year. The concerned Trial is in respect of Special Suit No. 675 of 2021 pending on the filed of Civil Judge, Senior Division, Thane. 2.

Learned counsel for the Petitioners seeks leave to withdraw this Petition and approach the Trial Court to make appropriate application for expeditious disposal of the said suit. 3.

Considering the submissions that the Petitioner No. 1/Original Plaintiff No. 1 is a senior citizen, request is quite reasonable. The Petition is allowed to be withdrawn with liberty to the Petitioners to make appropriate Application before the Trial Court for expeditious disposal of the suit.

If such Application is made, the same shall be decided expeditiously by the Trial Court by hearing all the parties and also by taking into account the fact that the Petitioner No. 1/Original Plaintiff No. 1 is a senior citizen.
