This is an application under Section 438 Cr.P.C. filed by the aforesaid Applicant seeking pre-arrest bail in C.R.No.32 of 2021 registered with Amboli Police Station for offences under Section 408, 420 of the Indian Penal Code.

Heard learned Counsel for the Applicant, learned APP for the State. I have perused the records and considered the submissions advanced by the learned Counsel for the respective parties . 3.

The aforesaid crime was registered pursuant to the FIR lodged by one Sanjay Dubey. By order dated 31.03.2022 this Court had granted Digitally signed by PRASANNA PRADEEP SALGAONKAR Date:

2023.07.15 12:23:16 +0530 interim bail to the Applicant. It was held that the question whether the PRASANNA PRADEEP SALGAONKAR SALGAONKAR

31 aba 552-22.doc Applicant is involved in the crime along with co-accused Bhavesh and whether amount was given to the Applicant for online is the question which needs to be investigated. It was also observed that there was no material on record to indicate that the Applicant was directly involved in the crime.

Learned APP states that pursuant to the said order, the Applicant has reported to the Investigating Officer, and he has been interrogated. His presence is not required for custodial interrogation. In the circumstances, interim bail granted by order dated 31.3.2023 stands confirmed.

The Applicant shall attend the Investigating Office as and when required.
