Learned counsel for Respondent No. 3 submits that, there is alternate remedy available to the Petitioner. The Petitioner can fle representation before Respondent No. 3 for redressal of his grievance raised in this petition.

Keeping in view the submissions made by learned counsel for Respondent No. 3, learned counsel for Petitioner submits that, the Petitioner will fle comprehensive representation agitating his Bhagyawant Punde

2/2 3-WP-2351-14.doc grievance which has been raised in the petition to the Respondent No. 3 within two weeks from today.

In case such representation is fled Respondent No. 3 shall decide the same as expeditiously as possible however, within 8 weeks from fling of such representation. Needless to observe that, Respondent No. 3 shall decide the said proposed representation on merits and without raising issue of limitation in fling the representation.

All the contentions raised in the present petition and also in the reply fled by respondents are kept open to be agitated before Respondent No. 3. We have not expressed any opinion on merits of the contentions raised by the Petitioner or respondents. It is for the Respondent No. 3 to take decision in accordance with law. With the above observations, writ petition stands disposed of. 5.

In view of disposal of this writ petition, Civil Application No. 1630 of 2017 does not survive and same stands dispose of. 6.
