This is a case where the applicant/accused was arrested on 19.12.2014 on suspicion for the murder of one Ramling R. Deshmukh which was committed on 17.12.2014 in the morning at village Bhalawani, Taluka Pandharpur, District Solapur. The deceased was the Sarpanch of the village and as per the case of the prosecution, he had some dispute over the purchase of land with one Rukmini Salunkhe and the applicant/accused is the nephew of Rukmini Salunkhe. 2.
The learned Counsel for the applicant/accused submits that the applicant/accused is innocent and there is no evidence against him. 3.
The learned Prosecutor while opposing the application pointed out the statement of one Shendge. She submitted that besides this 1 / 2
ba.456.2015_28.doc statement, till today, the police could not collect evidence against the applicant/accused.

Perused the statement of Shendge and prima facie, there is nothing against the applicant/accused. Though it is mentioned that the police are investigating the matter and they have to file chargesheet, it is to be noted that tomorrow 90 days are to be going to be complete for the investigation and the applicant/accused is inside the prison since 19.12.2014. the Investigating Officer is absent and hence, this Court is not in a position to know as to whether the Investigating Officer will be filing chargesheet or not. Be that as it may, there is no evidence seen against the applicant/accused. In these circumstances, the application is allowed on the following terms :
i) The applicant/accused shall be released on bail upon furnishing P.R. Bond in the sum of Rs.10,000/-. ii) The applicant shall not tamper with the evidence; iii) The applicant shall attend on all the Court dates. (MRS.MRIDULA BHATKAR, J.) 2 / 2
