Heard the learned Counsel appointed for the applicant and the learned APP for State.

This is an application under section 439 of the Code of Criminal Procedure, 1973. On 23rd April, 2015 this Court (Coram: Revati 1/3

Mohite Dere, J) while considering the application filed by the present applicant has observed that the trial of the present applicant is at the stage of framing of charge, but only because the application for bail is pending, the trial has not proceeded. The Court had observed that the charge is framed and the trial was likely to commence soon. It appears that the applicant herein files an application seeking enlargement on bail through post and has protracted the trial. It is in these circumstances, that the applicant does not deserve to be enlarged on bail. The applications filed by the applicant are rejected. The learned Sessions Court seized with the Sessions Case No. 10 of 2012 pending before the learned Sessions Judge, Palghar is hereby requested to make an endeavour to conclude the trial as far as possible at the earliest. The learned Sessions shall also ensure that the accused is produced before the Court on each and every date. All the three applications stand rejected and disposed of accordingly. 2/3

The learned Counsel has put in the best of the efforts to espouse the cause of the applicant. The professional fees are quantified as per rule, to be paid to the learned Counsel within 3 months from today. Office to communicate this order to the concerned Sessions Court at Palghar and also to the applicant who has lodged in Palghar jail.
