It is noted in the order dated 13 August 2004 that the complaint was filed because nature of work and other benefits of Class IV employees were being changed without issuing notice of change under Section 9A of the Industrial Disputes Act, 1947. The Industrial Court held in favour of the employees. In the order dated 13 August 2004, statement of the counsel for the Petitioner that the Petitioner will not change the nature of work and will not change the benefits and pay scale available, pending hearing of the petition, was recorded. Learned counsel for the Petitioner

bsb 2 902.WP4930.02.doc seeks time to take instructions as regard the present position and whether the Petitioner is still insisting on implementation of the circular dated 14 July 1997.

2. Stand over to 10 February 2016 for directions.' Learned counsel for the Petitioner states that, in view of passage of time and subsequent changes in service conditions, the circular dated 14 July 1997 has lost its relevance and, therefore, nothing further survives in this petition.
