***** Ms. Tanaya Goswami, AGP for Appellant.

***** CORAM : M.M. SATHAYE, J.

DATE : 13th DECEMBER, 2023 P.C. :

1.

Heard learned AGP for the Appellant-State, who has placed on record a letter dated 10/08/2023 issued by Deputy Collector (Land Husen

901 FA-328-2000.doc Acquisition) Ratnagiri informing that the subject matter land of First Appeal No. 325 of 2000 is covered under Government Resolution dated 03/11/2016 (for short "the said G.R.") and as such, the amount involved is below a particular limit.

2.

Learned AGP has also fairly submitted that other first appeals listed above (being First Appeal No. 326 of 2000 and First Appeal No. 328 of 2000) are also covered under the said G.R. She therefore, submitted that in view of the said G.R., appropriate orders be passed. 3.

In view of the admitted position that the amount/s payable under the order of the Reference Court in above appeals, is lesser than four-times of ready-reckoner value applicable to the subject matter land/s at the relevant time, under the said G.R., the State need not go in appeal. In other words, in present case, since the appeals are already filed, they need not be proceeded with. 4.

In view of this policy, the Appeals need not be entertained any more. The copy of the said letter along with the said G.R. is taken on record and marked 'X' for identification. All the aforesaid Appeals are dismissed accordingly. No order as to costs.

5.

In view of the disposal of the above Appeals, all pending Application/s therein, if any, are also disposed off. 6.

copy of this order.
