DATE : 9th SEPTEMBER, 2021 P.C:- Mr.Killedar, learned counsel for the respondent no. 1 tendered a copy of the letter dated 9th September, 2021 addressed by the respondent no.1 to the learned counsel stating that within sixteen weeks, the respondent no.1 would pass a fresh order after hearing the petitioner and after considering the written submissions if filed by the petitioner. He states that in view of the said instructions issued by the respondent no.1, the impugned order dated 31st January, 2014 stands withdrawn. Statement is accepted. The petitioners would be at liberty to file written submission before the respondent no.1.

The order that would be passed shall be communicated to the petitioner within one week from today. If any adverse order is passed against the petitioner, the same shall not be implemented for the period of two weeks from the date of communication of the said order. 3.

If any adverse order is passed against the petitioner, the petitioner shall have liberty to challenge the said order by filing appropriate proceedings.

If the order is in favour of the petitioner, the respondents in that event shall release the salaries and all other consequential benefits to the petitioner within eight weeks from the date of passing such order. 5.

Writ petition is disposed of in the aforesaid terms. No order as to costs.

It is made clear that this Court has not expressed any views on the merits of the matter.
