DATED : 13th JULY, 2022 P.C:- On 16/3/2020, it was directed that the applicants shall not be arrested and this relief was granted in the wake of the accusation faced by the applicants to the effect that they are signatories to the Memorandum of Understanding (MOU) and as per the execution of the MOU Rs.Fifty Lakhs was credited into the account of the arrested accused. Since it is not the case of the complainant that any amount is received by present applicants, but what allegation they face is that they are acting in connivance with the co-accused in whose account the amount was credited.
2/3 8 ABA 629-20.doc The learned APP, on instructions of the Investigating Officer, who is present in the Court state that the custodial interrogation of the applicants is not necessary. In the wake of the accusations, they are expected to render their co-operation to the Investigating Officer in concluding the investigation. Hence, the following order :-
O R D E R
(a) In the event of his arrest, the Applicant No.1 Sanjay Vasant Sonavane, applicant no.2 Saikumar Tukaram Gavankar and applicant no.3 Eknath Shantaram Jadhav in connection of C.R.No.31/2020 registered with APMC police station shall be released on bail on furnishing P.R. bond to the extent of Rs.25,000/- each with one or two sureties of the like amount.
(b) The applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and should not tamper with evidence.
(c) The Applicants shall make themselves available as and when required by the Investigating Officer.
