This is the third bail application filed by the aforesaid applicant, who is facing trial in Sessions Case No.44 of 2016 pending on the file of learned Extra Joint District Judge and Additional Sessions Judge, Niphad, for the offences punishable under Section 363, 364-A, 384, 387 and 342 r/w.120B of IPC and Sections 3 and 4 of the Arms Act.

Heard Mr. Gaurav Parkar, learned counsel for the Applicant and Ms Rutuja Ambekar, learned APP for the State. I have perused the 1/3

records and considered the submissions advanced by the learned counsel for the respective parties.

It is the case of the prosecution that on 17/1/2016 some unknown persons abducted Shahbaz and his friend Rahul at gun point. They were threatened and taken to some unknown place. It is alleged that the abductors demanded ransom of Rs.30Lacks. 4.

The applicant and other co-accused came to be arrested in the aforesaid crime. The previous bail applications No.2001/2016 and 2300/2018 were dismissed on merits. The applicant has filed this application mainly on the ground of delay in trial. Learned APP states that since the last date of hearing the prosecution has examined total 26 witnesses and 8 witnesses are yet to be examined. She states that the prosecution shall make an endeavor to examine the remaining 8 witnesses within one month. In the light of the said statement, I am not inclined to grant bail to the applicant on the ground of delay in trial. 5.

Considering the fact that the applicant is in custody since long, the learned trial Judge is directed to dispose of the Sessions Case within 3 months from the date of receipt of copy of this order. 2/3
