Heard learned Counsel for the applicant and the learned A.P.P. 2.

By this application, the applicant seeks suspension of his sentence and enlargement on bail, pending hearing and disposal of the aforesaid Revision Application.

The applicant has been convicted by the learned Magistrate, 53rd Court, Mulund, Mumbai, on 17th October, 2014 in C.C.No.466/PW/2012, for the offences punishable under Section 354 of the

2/3 Indian Penal Code and sentenced to suffer RI for one year and to pay fine of Rs.1000/-, in default to suffer RI for 15 days and under Section 323 of Indian Penal Code sentenced to pay a fine of Rs.1000/-, in default to undergo RI for 7 days. The appeal preferred against the said Judgment and Order has also been dismissed by the learned Additional Sessions Judge, vide Judgment and Order dated 3rd February, 2016. 4.

Learned Counsel for the applicant states that the applicant was on bail, pending the trial and his appeal and that he has not misused the liberty granted to him.

Considering the facts of the case, the sentence of the applicant is suspended and the applicant is enlarged on bail on the following terms and conditions:-

ORDER

(i) The applicant be enlarged on bail on furnishing P.R. Bond in the sum of Rs.10,000/- with one or two sureties in the like amount; (ii) The applicant shall furnish fresh bail bonds before the Trial Court.

The Application is allowed in the aforesaid terms and is accordingly disposed of.
