By the present application the applicant has prayed that upon lodgment of the FIR by Shri. Arun Bhosale and Shri. Abhijit Bhosale the Investigating Officer to give a notice of 72 hours to the applicant before his arrest. The application for pre-arrest bail preferred by the applicant has been rejected by the Trial Court by its order dated 8.1.2016 on the ground that the police have not filed FIR and there was no immediate apprehension of arrest to the applicant.

2) The learned APP on instructions of the Investigating officer submitted that CR bearing No.18/2016 has been lodged against the applicant with Tilak Nagar Police Station, Mumbai. In view of the said statement the learned counsel for the applicant seeks leave to withdraw the present application with liberty to file a fresh application before the Trial Court. Leave and liberty is granted.

3) Application is disposed of accordingly.
