This application is moved by the applicant-accused for pre-arrest bail as the applicant-accused apprehends arrest in C.R. No. 56 of 2017 registered with Kharghar Police Station, Navi Mumbai for offence punishable under section 420 read with 34 of the Indian Penal Code. The offence is registered on 9th February 2017. 2.

The learned senior counsel Mr. Mundargi for the applicantaccused submits that the Criminal Miscellaneous Application No. 149 of 2017 is kept for final hearing on 3rd March 2017. However, interim protection is rejected by the learned Additional Sessions Judge, Raigad-

Trupti 10-ABA-364-2017 Alibag by order dated 20th February 2017. Hence, this application is preferred for interim protection.

The learned prosecutor, on instruction, submits that the Investigating Officer will not take any coercive step in respect of arrest against the applicant-accused till 6th March 2017. The statement of the learned prosecutor is hereby accepted.

The learned Additional Sessions Judge, Raigad-Alibag to hear the said application finally on or before 6th March 2017. 5.

The applicant-accused shall attend the concerned police station, if he is required/ called on or before 6th March 2017. 6.
