1] Heard the learned counsel for the applicant. Heard the learned Additional Public Prosecutor.

2] With the assistance of the learned counsel for the applicant, I have gone through the evidence adduced during the trial. It is submitted that the applicant has already undergone a sentence of two years and three months.

3] In the circumstances, I am not inclined to suspend the wadhwa 1/2

16.appal280.15 substantive sentence imposed upon the applicant. However, considering the period already has been spent by the applicant in custody, it is directed that the appeal be listed on the final hearing board in the week commencing from 29th June, 2015. 4] Liberty to mention thereafter.

5] The application is rejected.

6] However, the liberty to the applicant to apply for afresh, in the event, of the appeal not being heard finally by 31st July, 2015.
