Rule. Learned counsel for Respondent No.1 to 5 waives service. Rule is made returnable forthwith. Writ Petition is taken up for ;nal disposal.

By this petition, ;led under Article 226 of the Constitution of India, the Petitioner is seeking direction for taking ;nal decision on the Petitioners Proposal dated 26/05/2008. Learned AGP states that said Proposal has been forwarded to Respondent No.5 having jurisdiction to decide and take ;nal decision on the said Proposal dated 26/05/2008. She further states on instructions that ;nal decision shall be taken preferably within a period of 8 weeks from today . Jyoti Mane 1 of 2

15-WP-4314-2023.doc Statement made by the learned AGP is accepted. In view of the statement made by the learned AGP no further directions are necessary in the petition. Petition is disposed of with above observations. The decision taken by the Respondent No.5 on the proposal dated 26/05/2008 shall be intimated to the Petitioner within a period of three weeks from the date of decision.

In the event, if decision is adverse to the Petitioner, in that event the Petitioner would be at liberty to take out appropriate proceedings as permissible in law. 4.

It is made clear that we have not expressed any view on the merits and the claim made by the Petitioner. All the contentions of the parties are kept open. The Proposal of the Petitioner shall be decided on its own merits. Hence, following order is passed:

Order 1.

Writ Petition is disposed of in abovesaid terms. 2.

Rule is made absolute.

No order as to costs.
