Mr. Godbole, the learned counsel for the Intervenor submitted that, the property of the Petitioner was mortgaged with the Applicant Bank which was ultimately sold by it, in pursuance of Order passed by a Court of competent jurisdiction.

In view thereof, the Application is allowed in terms of prayer clause (a).
The Petitioner is directed to implead the Applicant as Respondent No. 6. The said amendment be carried out within two weeks from today and an amended copy of the Petition be served upon the learned Advocate for the Respondents within the same stipulated period.
