Since the notification has already been issued u/s 5, section 8 and section 12 of the MPID Act in respect of property in the present Appeal, we find that it would be appropriate that the Applicant makes an Application under sub Section 3 of section 7 before the learned Designated Court. Nesarikar

We clarify that upon such Application being made, the learned Designated Judge to proceed with the Application without being influenced by pendency of the present Appeal. 3.

The Application is therefore disposed of. Taking into consideration that the issue is pending for a long time, the learned Designated Court is directed to decide the Application made by the Applicant, as expeditiously as possible, preferably within a period of three months from making of the Application.
