Having heard the learned counsel for the parties and having considered the fact that the contention raised in this Petition has not been controverted by the Respondents and keeping in view the fact that the question involved in this Petition is squarely covered by the order of the Division Bench of this Court in the case of Dilip Krushna Tadakhe and Ors. vs. State of Maharashtra and Ors. passed in Writ Petition No. 6168 of 2012 on 17 th December, 2013, we dispose of this Petition in terms of the said order.

In so far as the interest on the pension is concerned, we grant interest at the rate of 10% p.a. on the pension amount which should be paid to the Petitioner within a period of three months from the date of his superannuation. The said interest be calculated with effect from six months from the date of his retirement.
