Mr. Warunjikar, learned counsel for the petitioner, having taken instructions from his client who is present in the Court, seeks leave to withdraw the petition with liberty to make a representation before the Government for relaxation of the regulation regarding delayed payment charges towards consideration of the subject flat.

Mr. Kulkarni, learned counsel for CIDCO has no objection if the petitioner is given liberty to make a representation to the Government as prayed.

In the above circumstances, we deem it convenie2nt to dispose of this petition by granting liberty as prayed for. 4.

In the event the petitioner makes such a representation to the Government through CIDCO within two weeks from today, the same shall be decided as expeditiously as possible and preferably within a period of three months from the date of receipt of a copy of this order.

It is made clear that we have not gone into merits of the matter. All points and contentions of the respective parties are kept open and such representation shall be decided independently and in accordance with law.
