Perused the order impugned herein.

It is informed that the learned Advocate for the applicant met with an accident and therefore, could not reach the Court on the given date and hence, adjournment application was moved in the afternoon. The Trial Court still issued non-bailable warrant against the applicant.

In the aforesaid circumstances, the order of issuance of nonbailable warrant, is hereby set aside. 5.

Learned Advocate makes a statement that the applicant would appear before the Trial Court on the next date and proceed with the trial. If the applicant moves an application for setting aside "no cross" order, the Trial Court would decide the same with liberal approach.

In the result, the application stands disposed of accordingly. (R. G. AVACHAT, J.)
