Leave to amend the prayer clause, granted. Amendment to be carried out forthwith.

Heard learned Counsel for the applicant and learned A.P.P for the State.

By this application, the applicant seeks return of the his passport bearing No. L-920478 lying in the Versova Police Station (deposited in connection with C.R. No. 334 of 2014). 1/3

Learned Counsel for the applicant states that pursuant to the order passed by this Court dated 15th January, 2015, the applicant was directed to deposit his passport to the Investigating Officer. She further submits that the applicant intends to travel abroad and therefore seeks return of the passport for a period of two months to enable the applicant to travel abroad. She submits that the applicant is ready to give an undertaking and abide by the conditions that may be imposed by this Court. 5.

Learned A.P.P states that an undertaking of the applicant be given before the trial Court that he will surrender his passport on his return and will give an itinerary to the investigating officer before leaving the country. The report submitted by the A.P.P is taken on record. 6.

In view of the aforesaid, since the applicant intends to travel abroad, the following order is passed :

ORDER

(i) The police of the Versova Police Station is directed to hand over the passport to the applicant on 12th May, 2015 for a period of two months.

(ii) The applicant shall deposit the passport on 12th July, 2015 before the concerned Officer.

(iii) The applicant shall give an undertaking before the trial Court that he will surrender the passport before the investigating officer as well as he shall give the details of his itinerary before leaving the country to the investigating officer of the concerned police station. (iv) The undertaking in the above terms be given by the applicant on or before 22nd May, 2015 to the trial Court. 7.

Application is accordingly disposed of.

The applicant will be at liberty to file a separate application for return of passport, permanently.
