The Learned Counsel for the parties i.e. Mr. Sarmbalkar and Mrs. Dhamale tender consent terms bearing today's date 6-4-2017 evidencing the settlement arrived at between the parties. The said consent terms have been signed by Mr. Sarmbalkar and Mrs. Dhamale as the Advocates for the Applicants and the Respondents. The consent terms have also been signed on behalf of the Applicants by the Applicant No.2 Shivaji R. Valanju for himself
and as a Power of Attorney for the other Applicants i.e. the Applicant Nos.3 to
6. The consent terms have also been signed by the Respondent No.1(c) Shreya Salvi for herself and as a Power of Attorney for the Respondent Nos.1(b) and 1(d). Both Shivaji Valanju and Shreya Salvi are personally present in Court. In so far as Shivaji Valanju is concerned, he is identified by Mr. Sarmbalkar and he is also identified on the basis of his Adhar Card No.360411563317. When put in box and queried he states that the signature on the consent terms is his and that he has written his name in hand below his signature. He further states that he has been read over and explained the consent terms and that he has understood the same and the same are acceptable to him and he he has signed them of his own free will and volition. Mrs. Sheetal S. Valanju the wife of Shivaji Valanju is also present in court. She also states that she has also understood the consent terms and that they are acceptable to her and her husband and that her husband has signed them of his own free will and volition.
The Respondent Mrs. Shreya Salvi who is personally present in court, is identified by her Advocate Mrs. Dhamale, she is also identified by her driving licence No.MHO4 20100059285 which is issued on 13-12-2010 and is valid up to 12-2-2019. She states that she is the power of attorney of the Respondent No.1(b) Mr. Prakash Kolte who is her brother and the Respondent
No.1(d) Madhavi Chavan who is her sister. The said power of attorneys have been executed in her favour on 1-1-2015 and 18-12-2006. She further states that she has read the consent terms and understood the same and that the same are acceptable to her and she has signed them of her own free will and volition, on behalf of herself and the Respondent Nos.1(b) and 1(d). The consent terms are paginated from page Nos.1 to 3. The Learned Counsel for the parties state that the photo copies of the three power of attorneys would be tendered in this court as soon as the photocopying is complete. Statement accepted. The consent terms are marked as "X" for identification. The power of attorneys are also marked as "Y and Z & Z-1" respectively, for identification. The Civil Revision Application is accordingly disposed of in terms of the consent terms.
In view of the disposal of the above Civil Revision Application, the Civil Application No.149 of 2011 does not survive and to accordingly stand disposed of as such.
