Aniket Verma v. The Union Of India, Through Secretary, Home Dept And ORS
suresh 914-WP-2400.2014.doc
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION WRIT PETITION NO.2400 OF 2014 Aniket Verma .... Petitioner Vs.
The Union of India & Others .... Respondents Mr. Shubham Kaushal i/by Kranti L.C. for the Petitioner.
Ms Neeta Masurkar for Respondent Nos.1 & 4.
Mr. Abhijeet Joshi for Respondent Nos.2 & 2(b). CORAM: S.C. DHARMADHIKARI & M.S. KARNIK, JJ.
DATE : FEBRUARY 15, 2019 P.C:
1.
Heard both sides. We do not grant any request for adjournment made by the petitioner's Advocate and simply to enable him to obtain instructions from the petitioner. 2.
We have perused the two orders passed by this Court - one of 2-12-2014 and the another of 11-12-2014. 3.
A combined reading of these two orders indicates
suresh 914-WP-2400.2014.doc that the petitioner was, despite the dispute on equivalence, allowed to take an interview and particularly described in para 5 of the order passed on 11-12-2014. The result of that shall not be declared was the direction.
4.
Now that the interview result is also out and Mrs. Masurkar, who has been appearing throughout in this matter, on instructions, informs that the petitioner could not succeed.
5.
We do not think that this Court having assisted the petitioner in this matter, now anything survives for our consideration. The discussion on any academic issue, particularly of equivalence, will be futile once the petitioner, though allowed to take interview, could not succeed on merits. In the circumstances, this writ petition is rendered infructuous by passage of time and is dismissed as such.
