IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION CIVIL APPLICATION NO. 1132 OF 2015 IN SECOND APPEAL NO.285 OF 2013 Satwaji Tukaram Pandhare ..

Applicant Vs.

Sarla Satwaji Pandhare ..

Respondent --- Mr.Ramdas Shelke for Applicant.

Mr.Balasaheb Deshmukh for Respondent.

--- CORAM : R.D. DHANUKA, J.

DATE : 2nd September 2016 P.C.

.

By this civil application, the applicant (original respondent in the Second Appeal No.285 of 2013) seeks an order and direction against the original appellant for maintenance of Rs.2000/- per month to the applicant granted by the appellate Court. 2.

This Court granted stay on the impugned order passed by the appellate Court by an order dated 24th July 2013 and confirmed on 13th January 2014. It is not in dispute that a decree of divorce granted by the learned trial Judge in favour of the original appellant and confirmed by the appellate Court is not impugned by the applicant by way of filing of any second appeal. There is no dispute that findings rendered by the two Courts against the applicant are concurrent findings which are not impugned by the applicant. No case is thus made out for modification of the orders dated 24th July 2013 and 13th January 2014 passed by this Court. Civil application is accordingly dismissed. No order as to costs.
