On 16th December, 2020, after making prima facie observations on perusal of the case of the prosecution, the applicant was granted interim protection in the event of his arrest subject to the stipulation that he will co-operate with the investigation. Mr.Gavand, the learned APP states that pursuant to this direction, the applicant has co-operated with the investigation.

In the order dated 16th December, 2020, it was categorically noted that the essential ingredient of Section 3 of PITA being, having knowledge that the place is used as a brothel, was conspicuously absent. No material has been placed on record by the prosecution to establish said knowledge M.M.Salgaonkar
