The Petitioners are making grievance as regards nonobservance of the directions issued by this Court while disposing of the Writ Petitions by an order dated 09.05.2013. An affidavit-in-reply has been presented by Mr. Bharat A. Waghmare, the Deputy Collector (Rehabilitation), Pune, Respondent No.4 herein, informing the Court the steps taken as regards the implementation of directions. It is informed that out of 12 project affected individuals, 6 have already been allotted lands considering their entitlement. So far as the other 6 individuals are concerned, their documents have been verified and it is noticed that those Petitioners are also entitled to secure allotment of land as a rehabilitation 2/3
measure. It is further informed that those 6 individual-Petitioners have claimed a particular piece of land which is stated to be involved in a litigation. Such of those individual-Petitioners have also recorded in writing that they would prefer to wait till the conclusion of the litigation with a view to secure allotment of those pieces of land claimed by them. In view of the explanation tendered by the Respondent on oath, the grievance raised by the Petitioners in the instant group of Contempt Applications substantially stand redressed.
It is further informed that an eligible allottees i.e. 6 individual-Petitioners would be put in possession of the land allotted to them as expeditiously as possible preferably within the period of 15 days from today. The statement made is accepted.
It is further assured that on conclusion of controversy raised as regards the lands claimed by other 6 individual-Petitioners, appropriate final decision would be taken and eligible allottees would be allotted land. In view of above, Contempt Petitions stands disposed of. Notices issued earlier stand recalled.
