The applicant's Appeal challenging his conviction and the sentence imposed upon him by the Addl. Sessions Judge, Khed Rajguru Nagar has already been admitted.
By the present application, the applicant/appellant prays that the sentence imposed upon him by the trial court, be suspended during the pendency of the Appeal, and that he be released on bail.
I have heard Mr.Rohan Nahar, learned counsel for the applicant. With his assistance, I have glanced through the
Tilak 2/2 (7)APPA-289-15 judgment delivered by the trial court, and the copies of the notes of evidence of witnesses recorded during the trial. On taking a prima facie view of the matter, this does not appear to be a fit case for suspension of the sentence that has been imposed upon the appellant.
Application is rejected.
However, liberty to the applicant/appellant to have the hearing of the Appeal, expedited.
Liberty to file a private paper book.
