Since the learned counsel for the applicant was asked to argue on the question of maintainability of the Appeal without seeking leave, he submits that he had actually made an application for Leave to Appeal. He submits that he has never taken the position that no leave would be necessary. According to him, inspite of this position, the matter came to be numbered as an Appeal. This appears to be correct.

Under the circumstances, it is directed that let this be treated as an Application for Leave to Appeal, be numbered accordingly, and be listed on board for admission on 25 th March 2015.
