Heard learned counsel for the parties.

By this Application, the Applicant seeks his enlargement on bail in connection with C. R. No. 735 of 2017 registered with the Ghatkopar Police Station, Mumbai, for the alleged offence punishable under Section 376 of the Indian Penal Code.

Perused the papers. Admittedly, there are no allegations of 376 qua the Applicant. It appears that although, it was alleged that a call was made to the prosecutrix from the Applicant's mobile, investigation revealed that no such call was made from the Applicant's mobile. There

BA 509-18.doc is no material to connect the Applicant with the alleged offence. 4.

Considering the aforesaid, the Application is allowed and the Applicant is enlarged on cash bail on the following terms & conditions :-

O R D E R

(i) The Applicant be enlarged on cash bail in the sum of Rs. 10,000/-, for a period of four weeks from today; (ii) The Applicant shall furnish P. R. Bond in the sum of Rs. 10,000/-, with one or two sureties in the like amount, within the said period of four weeks of his release on cash bail. 5.

The Application is allowed in the aforesaid terms and is accordingly disposed of.
