IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION CRIMINAL WRIT PETITION NO.862 OF 2015 Smt.Sunita Annaji Parwade .... Petitioner versus The State of Maharashtra & Ors.

... Respondents .......

• Mr.Sachin B. Chandan, Advocate for Petitioner. • Mr.K.V. Saste, APP for Respondent/State.

CORAM : B. P. DHARMADHIKARI & SARANG V. KOTWAL, JJ.

DATE : 29th NOVEMBER, 2018.

P.C. :

1.

Grievance of Petitioner is about gruesome murder of her daughter in July 2013, which is still not fully investigated into. It appears cognizance was already taken vide C.R.No.196/13 on 02/07/2013.

2.

Affidavit filed before this Court by one Ramesh Baburao Nangare, Police Inspector of Malvani Police Station, Mumbai, shows that 'A' summary was prepared and filed in Nesarikar

2 / 2 02-WP-862-15.odt Court of Metropolitan Magistrate, Court No. 62, Bhoiwada, on 17/07/2014 and it was later on withdrawn by police machinery. 3.

Learned Counsel for Petitioner states that copy of this affidavit is not served upon it and therefore neither he nor the Petitioner's mother are aware of these developments. He informs that the Petitioner was once called in some Court, but the purpose for which she was called for is not clear. 4.

We in this situation find that interest of justice can be met with by directing the concerned police station to file appropriate statement/report in the competent Court within four weeks.

5.

With liberty to Petitioner to take such other steps as are open in law, we dispose of present Petition. (SARANG V. KOTWAL, J.) (B. P. DHARMADHIKARI, J.)
