Applicant is apprehending arrest in connection with C.R.No.I-515 of 2019, registered with Kalwa Police Station, Thane, for ofences under Section 498A read with 34 of Indian Penal Code. The marriage between applicant and complainant was performed on 6th June, 2015. The FIR was lodged on 4th November, 2019. According to complainant, the accused had harassed her. She was abused, assaulted. Demand was made for Digitally signed by RajeP. Aher Date:

Aher buying house. Her ornaments were retained by accused. Learned advocate for the applicant submitted that the complainant had left the matrimonial home on 19th April, 2019,

rpa 2/3 9 aba 649 2020.doc and, thereafter, the FIR was lodged in November 2019. Applicant's daughter was with him when the complainant left matrimonial home. On 30th May, 2019, complainant visited the matrimonial home and had taken away ornaments belonging to her. On 14th June, 2019, complainant visited applicant's house and created ruckus. N.C. Complaint was lodged by applicant. The application of co-accused was allowed by Sessions Court. Applicant was granted interim protection vide order dated 17th March, 2020. It is submitted that the applicant had visited police station and has co-operated with the investigation. According to applicant, Jwellery was taken away by the complainant when she had visited the matrimonial home. It is further submitted that parties are trying to resolve the dispute in the interest of the child. In view of the aforesaid circumstances, this application can be allowed.

Hence, I pass the following order:

:: O R D E R ::

(i) Anticipatory Bail Application No.649 of 2020, is allowed;

rpa 3/3 9 aba 649 2020.doc (ii) In the event of arrest of the applicant in connection with C.R.No.I-515 of 2019, registered with Kalwa Police Station, Thane, the applicant be released on bail on his executing P.R. Bond in the sum of Rs.25,000/-, with one or more sureties in the like amount;

(iii) Applicant shall report the investigating oficer, as and when called for;

(iv) Anticipatory Bail Application No.649 of 2020, stands disposed of.
