Heard learned Counsel for the parties. By this petition under Article 227 of the Constitution of India the Petitioner challenges the order dated 28.01.2015, 10.03.2015 and 24.03.2015 passed by the Jt. Civil Judge, Junior Division, Kalyan in Special Darkhast No.28/2014.

The main objection of the Defendant is in respect of the auction of the suit property i.e. Flat No.702, Ankit CHS Ltd., Sai Chowk, Khadakpada,, Barawe Road, Kalyan. It is to be noted that subsequently, the 2nd Jt. Civil Judge, Senior Division, Kalyan passed order dated 30.11.2015 in which the possession was handed over by the Petitioner Defendant to the Respondent decree holder in respect of the suit property.
