Learned Counsel for the Petitioner at the outset makes a statement that the Petitioner is restricting this petition to the relief claimed in prayer clause (c) only. The statement is accepted. Prayer clause (c) reads as follows :

"c. The Respondent No. 2 directed to decide the representation dated 21/04/2016 in view of the order passed by this Hon'ble Court in WP 5258 of 2012."

The learned AGP has no objection if respondent No. 2 is directed to decide the petitioner's representation dated 21/4/2016. Talwalkar 2/2

57.wp6487.17.doc In the above circumstances, we deem it convenient to dispose off this petition by directing respondent No. 2 Education Officer (Secondary), Zilla Parishad, Nashik, Dist. Nashik to decide the Petitioner's representation dated 21/4/2016, copy of which is at page 30, as expeditiously as possible and preferably within a period of 8 weeks from date of receipt of a copy of this order. Ordered accordingly. It is made clear that we have not gone into the merits of the respective claims and respondent No. 2 shall decide the said representation independently on its own merits and in accordance with law.

In order to enable respondent No. 2 to comply with this order, the Petitioner shall remain present before him alongwith copy of this order as well as copy of the said representation on 19th March, 2018. The Writ Petition stands disposed of.
