We have heard the learned counsel for the petitioners. 2.

The grievance of the petitioners is that without holding Gram Sabha, the financial liability is sought to be passed on the villagers. The work order has been issued in favour of respondent no.6. It is submitted that the resolution is purportedly shown to be of a Gram Sabha but no such Gram Sabha was ever held, thereby resolving to take up the work under the Jal Jeevan Scheme. It is further submitted that the representation/application has been given to the respondent no.2. The cognizance of the same is not taken and the contractor would proceed with the work.

We have heard the learned AGP also.

In case the representation/application of the petitioners (page 160 of the petition) is pending with respondent no.2,

18-WP-3469-2023 then the respondent no.2 shall consider the grievance putforth by the petitioners and take decision upon it on its own merits in accordance with the record expeditiously, preferably within six weeks after hearing the concerned parties. 5.

Depending upon the decision taken, the parties may take further steps.

The writ petition stands disposed of accordingly. No costs.
