The petitioner was appointed against a reserved post in Zilla Parishad, Nashik and was employed on the basis of a caste validity certificate issued to him. Though he is retired from service on attaining the age of superannuation, the pensionary benefits are withheld for failure on the part of the petitioner to produce the caste validity certificate from the competent scrutiny committee.

After the writ petition was argued for some time and noticing that the petitioner is without any pensionary benefit from last more than six months, we direct the committee to J.V.Salunke,PA

902-WPST.5741.2017.doc complete the process of scrutiny and verification of the claim of the petitioner as expeditiously as possible and within a period of eight weeks from the date a copy of this order is produced before the committee. In the event the claim of the petitioner is not verified and scrutinised within this time, the petitioner can seek provisional pension from Zilla Parishad, Nashik by making an application invoking the service rules and regulations in that behalf.

The writ petition is disposed of by clarifying that the Court has not expressed any opinion on the rival contentions. There would be no order as to costs.
