Leave to amend is granted to the petitioner for deleting the name of the respondent no.3. Amendment shall be carried out within a period of one week from today. Re-verification is dispensed with. 3.

Rule. Learned AGP waives service for the respondent no.1. Mr.Deokar, learned counsel waives service for the respondent no.2. 4.

By this petition filed under Article 226 of the Constitution of India, the petitioner is seeking direction against the respondent no.2Education Officer for granting approval for the petitioner's post w.e.f. 15th June, 2011.

Learned counsel for the petitioner states that although the proposal was sent by the Management on 9th August, 2011 to the respondent no.2-Education Officer, the said proposal is not yet considered by the respondent no.2-Education Officer. 6.

In view thereof, the respondent no.2-Education Officer shall take decision on the proposal dated 9th August, 2011 sent by the respondent no.3-Management to the respondent no.2-Education Officer for granting approval to the petitioner's post w.e.f. 15th June, 2011 within a period of eight weeks from today. The said decision shall be communicated to the petitioner as well as the respondent no.3Management within a period of one week from the date of taking decision.

Writ Petition is disposed of in aforesaid terms. Rule is made absolute accordingly. There shall be no order as to costs. [R. I. CHAGLA, J.] [R. D. DHANUKA, J.]
