The petition is filed for quashing the proceedings of regular criminal case No.668/PW/2016 pending on the file of learned Metropolitan Magistrate, 27th Court, Mumbai. Learned APP points out and learned counsel for the petitioner does not dispute that the petitioner is shown as wanted accused in the said case. Subsequent to filing of the charge-sheet against some other accused, the petitioner is arrested and, as of today, the investigation is going on. As of today, the charge-sheet/report is not filed against the present petitioner. In the above circumstances, in our view, the petition is premature and, therefore, the same is dismissed.
