By this application, the Applicant has prayed for pre-arrest bail apprehending his arrest in C.R.No.54 of 2018 registered with Worli Police Station for the offences under Section 419, 420, 406 r/w. 34 of Indian Penal Code.

Heard Mr. Sayyed, learned Counsel for the Applicant and Shri Mrs. Takalkar, learned APP for the State. I have perused the records and considered the submissions advanced by the learned Counsel for the respective parties .

The aforesaid crime was registered pursuant to the FIR lodged by Jagannath Rajaram Rashivate. The allegation of the Complainant is that the Applicant has cheated him to the tune of Rs.5,50,000/-. 4.
The Applicant Pradeep Naik has filed an affidavit stating that he is
ready to pay Rs.1,50,000/- by 15.03.2022, Rs.2,00,000/- by 25.03.2022 and Rs.2,00,000/- at the time of filing the quashing petition. The same is acceptable to the Complainant who is present before the Court. The Complainant also accepts that he has received two Demand Drafts for total sum of Rs.1,50,000/-.

Considering the nature of the offence, and the fact that the parties have agreed to settle the matter and file quashing proceedings, the Applicant is granted pre-arrest bail on the following terms and conditions:- (i) In the event of arrest of the applicant in C.R.No.54 of 2018 registered with Worli Police Station the applicant be released on bail on furnishing bail bond of Rs.15,000/- (Rupees Fifteen Thousand Only) with one or two solvent sureties in the like amount, to the satisfaction of the Investigation Officer. (ii) The Applicant shall provide his permanent as well as temporary address, if any, and his contact details to the Investigating Officer.
(iii) The Applicant shall not change his residential address without prior intimation to the Investigation Officer. (iv) The applicant shall not interfere with the complainant and the other witnesses in any manner.
(v) In the event of default, the bail order shall stand recalled without further reference to the Court.
