Heard the learned Counsel for the Petitioner applicant, the learned Counsel for the respondent No. 3 and learned AGP. The parties to the petition are present before the Court. Respective Counsel have filed Consent Terms, which are drawn between the petitioners and the respondent No. 3, as the Petitioners are not seeking any specific relief against the respondent Nos. 1 and 2. The consent terms duly signed are taken on record and marked as Article X collectively.

The parties to the petition are duly identified by the Counsel Talwalkar

The parties to the petition have further given an undertaking that they would abide by the Consent Terms which are filed in this Court. It is submitted that the conditions mentioned in paragraph-11 of the Consent Terms is also being followed. The duly payable cheques are with the advocate of the petitioner and that they will be duly paid on complying with the terms and conditions.

The respondent No. 3 has undertaken to withdraw the suit filed before the City Civil Court.

In view of the above circumstances, the Petition is allowed in terms of the Consent Terms and stands disposed of. [SMT. SADHANA S. JADHAV, J.] Talwalkar
