The learned APP for the respondent-State at the outset submits that charge-sheet in subject Criminal Case is filed. 2.

In view of the statement made by the learned APP Mr.Mundargi, learned counsel for the petitioner seeks leave to withdraw the petition with liberty to file discharge application before the Trial Court. Leave granted with liberty as prayed for. Hence petition is dismissed as withdrawn.

It is expressly made clear that we have not gone into the merits of the matter and this order should not be construed as an expression on merits and all points and contentions of all parties are kept open.
