This is an application for anticipatory bail in connection with CR No.87 of 2018 registered with Malwani Police Station. Learned APP submitted that the applicants have directly approached this Court. Whereas, learned counsel for applicants pointed out the order dated 28th December 2017 passed by Sessions Court disposing off the application preferred by applicants for anticipatory bail. On perusal of the said order it is apparent that the said application was filed prior to registration of FIR and since the applicants were not present, the same was disposed off. Pursuant to the said order, the FIR was registered on 23rd January 2018. The applicants are granted interim protection by this Court on 5th March 2018.

Considering the aforesaid circumstances, the applicants is permitted to prefer an application before the Sessions Court for anticipatory bail within two weeks from today. Interim protection granted by this Court vide order dated 5th March 2018 shall continue till 11th September 2018. The Sessions Court shall decide the application for anticipatory bail on merits without being influenced by the disposal of earlier application. Criminal Anticipatory Bail Application No.358 of 2018 is disposed off.
